*FEATURED ON THIS EPISODE...*
0:00 - Intro
2:20 *Disability benefits cut off and returning to work*
I was off work due to a serious medical condition for about half a year. I received disability benefits while on leave. My benefits were pre-emptively cut off by the insurer and now my employer wants me back at work. What can I do?
6:41 *Long-service employee severance*
I’ve been trying to persuade my friend to contact Lior’s office. He was a manager for 39 years, and they’ve only offered him 32 weeks of severance. I told him not to sign anything.
• Severance Pay: bit.ly/Severance-Pay
8:42 *Need work accommodations due to injury*
I’m 50 and have been at this company for 8 years. I probably need to take some time off as an injury is giving me a lot of trouble. I’m worried upon a return to work, it will still cause problems and I’ll lose employment.
12:20 *Title change but no pay cut*
My title was changed from department manager to section manager. There was no change in pay just a shift change. There could be another change implemented in a few months. Is this a constructive dismissal?
*Common myths about severance packages*
14:22 1️⃣Myth #1: You are not entitled to a severance package if let go during probation.
15:52 2️⃣ Myth #2: Severance packages must be accepted immediately or by an employer’s deadline.
17:04 3️⃣ Myth #3: Everyone in a company gets the same amount of severance pay as their coworkers.
17:51 4️⃣ Myth #4: If you are forced to resign from your job, you are not owed any severance.
18:23 5️⃣ Myth #5: Severance only encompasses your basic salary and wages.
20:54 *Employee rights when employer retires*
I am a dental assistant and have been employed for 8 years. The owner of the business has announced his retirement and future closure of the office in about 6 months. I’m almost 60 and nervous that this will mean months of uncertainty and unemployment. Am I owed anything other than the notice of closure?
22:38 *Bullying by a manager in the workplace ignored*
After repeated complaints, my company refuses to reprimand or deal with a manager who has made many inappropriate comments and has criticized my performance as it relates to my disability. What can I do?
*Rapid Fire Can my employer...?*
26:33 • Can my employer cancel my approved vacation period?
27:00 • Can my employer put me on a performance plan?
27:25 • Can my employer ask me to sign a new contract?
27:43 • Can my employer tell me to work at a new, distant location?
28:20 • Can my employer put me on a temporary layoff until further notice?
28: 36 • Can my employer reduce my pay due to performance reasons?

It always infuriates me when idiots say, "Well, it's their business, they should have the freedom to run it how they want, just get another job." Uh, NO. No one...I repeat, NO ONE should have the right to force a medical procedure on you. That should be between you and your doctor. The whole "Just get another job" statement won't help if every, or almost every employer decides to enforce it. I'm all for working hard and being a good employee, but there needs to be boundaries. People shouldn't let their employer abuse them or overstep boundaries.

Never sign anything from your employer or Union or Insurance company . They play a game to bamboozle and trick you out of your rights and infringe upon them. Always make decisions with a lawyer on your side. The Union lawyer is not on your side.

Is the elimination of position considered the same as layoff?

    • @SamfiruTumarkinToronto

It certainly is. If your position has been eliminated, you have been laid off, fired, terminated, etc. If this happens to you in Ontario, Alberta or B.C., and you are non-unionized, you need to contact our team for severance advice.

Employers should not use retaliatory measures, spread falsehoods and go as far as defaming anyone's character. Employers are only supposed to say whether the person worked for them or not. In addition, employers are obligated to let the employee know they decided to terminate their employment, prior to spreading false claims because the employee was advised to seek remedy with the Department Of Labor. I was not in DC yesterday. Google is not my first choice of Search Engines. Neither is Bing. I applied for other jobs. I don't want to be lumped into a false narrative based on abject LIES that fits into someone else's futuristic agenda that is antithetical to what I believe is God's plan for my life. That being said: I never met Hunter Biden, have not been in New York since 2018 (one time in early 2018), In addition: This is neither a solicitation nor an invitation, this Is the truth. I am and have been completely abstinent for almost eight years here in Philadelphia PA USA.05-22-2016 (later) to 06-13-2024-06-14-2024 (over 419 weeks)so far, unless you include leap years) through September 8 so far or whenever this stops. My eldest son (who is diagnosed with a disability) is still a virgin (to my absolute very best knowledge), and my youngest son is married and had a baby girl with his wife. 05-23-2016 (while I was running for Congress)-06-13-2024 to 06-14-2024, nor do we have STI's or STD's, no Cancer, no COVID-19, not LGBTQIA and do not have sex, nor have been sexually active in years, and no longer have a menstrual cycle. I was a virgin when I went to college, and was at home praying on September 11th as well as election days (normally). I am now 55 years old. I have not gotten my paycheck in almost 60 weeks. I am obviously not pregnant. God is still Awesome! My Mammogram was negative again. No Cancer no COVID-19. I passed all of my courses required for my MD in addition to becoming a member of the American Bar Association. I was a 17 year old virgin when I went to FAMU. I have had years in between where I didn't mess around at all, like when my sons and I lived in Georgia, and afterwards during my second 40 day fast, when my ex husband went away into the military, during my pregnancy, every day of 2012 and most of 2013, and more time than not in between.

As a manager on salary at a retail store. I was suspensed due to not opening, but I couldn't due to register freezing up. District Manager knew about it. I did call ERC to fix the issue. ERC gave me a ticket number. I asked DM for how long. DM said until HR decides. Well HR never got ahold of me. I filed for unemployment a month later I was granted for benefits. The company lied and said they let me go because i blocked exit doors. not true, DM never got a hold of HR until unemployment got involved. I loved my job I would still be there, can I get front pay. The company does owe me compensation. so can i add on front pay

I have initiated a Human Rights complaint now awaiting MEDIATION. Besides Common Law damages, severance and Punitive damages, what other damages can we go after these COCK ROACHES for ?

I am a so called independent contractor driver. I lease a vehicle from a company on a daily basis and I pay my own insurance on the car and I take the vehicle home each night. However I am required to wear a uniform I am also told that I am not allowed take the car out of town without permission as they are constantly watching me on a survalance camera that they have recently placed in each vehicle so they see what other accounts I work for as a independent contractor They are now telling us that if we fall below their 95% level they will remove us from the vehicle for 24 hours even though we prepay our lease cost in advance A lot of us are independent contractors for this company and some of us have opted not to file our income tax due to the fact the we do not see ourselves as independent contractors because of so many things that are being done is considered as employees and not as independent contractors. Can you please help us I can be reached at ladellariley19355@gmail.com

In a cynical nutshell, Ontario is getting tough on employers who mistreat their workers by hiking up fines for violations of labor laws. The government plans to double fines for individuals who breach the Employment Standards Act, with maximum penalties reaching $100,000. Repeat offenders could face fines up to $5,000, multiplied by the number of affected employees. This move aims to deter practices like withholding wages, discriminating against employees on parental leave, or maintaining unequal pay. The government also intends to extend health coverage to wildland firefighters, create a new apprenticeship pathway in high schools, and eliminate the need for sick notes for short absences. While these measures may appear promising, some may see them as mere lip service in a system where exploitation of workers remains prevalent. 24y 5m
